1. Eligibility
- Only licensed real estate agents and authorized personnel may access our MLS. Proof of licensure and authorization is required during account registration and may be requested periodically.
2. Accuracy of Listings
- Agents must ensure that all property listings and related information are accurate and complete. Misrepresentation or falsification of information is strictly prohibited and will result in disciplinary action.
3. Confidentiality and Data Protection
- Agents must protect the confidentiality of all client and property data. Unauthorized sharing or distribution of MLS data is strictly forbidden. Agents must comply with all applicable data protection laws.
4. Intellectual Property Rights
- All content within the MLS, including property listings, photos, and descriptions, is protected by intellectual property laws. Agents may not copy, distribute, or create derivative works from MLS content without explicit permission.
5. Fair Usage
- The MLS must be used in a manner that does not negatively impact system performance or service for other users. Excessive or inappropriate use, such as data scraping or spamming, is prohibited and may result in account restrictions or termination.
6. Prohibited Conduct
- The following activities are strictly prohibited:
- Posting false or misleading property information.
- Engaging in fraudulent activities or transactions.
- Using the MLS for unauthorized commercial purposes.
- Harassing, threatening, or abusing other users.
- Attempting to gain unauthorized access to MLS systems or data.
7. Legal Compliance
- Agents must comply with all local, state, and federal laws and regulations governing real estate practices. Any violation of these laws will result in immediate suspension or termination of MLS access and may lead to legal action.
8. Account Security
- Agents are responsible for the security of their MLS accounts. Sharing login credentials with unauthorized individuals is prohibited. Agents must report any suspected security breaches immediately.
9. Modification of Terms
- Pierce & Pierce reserves the right to modify these terms and conditions at any time. Agents will be notified of any changes, and continued use of the MLS constitutes acceptance of the updated terms.
10. Termination of Access
- Pierce & Pierce reserves the right to suspend or terminate MLS access for any agent who violates these terms and conditions. Termination decisions are final and non-negotiable.
11. Dispute Resolution
- Any disputes arising from the use of the MLS will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Agents agree to waive the right to a trial by jury.
By accessing and using the Pierce & Pierce MLS, agents agree to comply with these strict terms and conditions. Non-compliance will result in immediate suspension or termination of access and potential legal action.
